Heroin Possession Charges and Penalties

It is illegal to possess heroin in any quantity in Illinois. The more heroin one is found to possess, the more severe the charges and the sentence for the crime becomes. Possession of heroin is a Class 1 felony for all amounts possessed of 15 grams or more. Possession of less than 15 grams is a Class 4 felony. Penalties for heroin possession are as follows:

  • 15 to 99 grams – 4 to 15 years
  • 100 to 399 grams – 6 to 30 years
  • 400 to 899 grams – 8 to 40 years
  • 900 grams or more – 10 to 50 years

Possession with intent to deliver carries penalties of from 3 to 60 years in prison. Additionally, a defendant may be fined the full street value of the drug or up to $200,000, whichever is greater.
